1. COMPANY AND WEBSITE

1.1 COMPANY

Mytodo Planner is a registered brand that belongs to the company Thensel snc which is the only one to have full physical and intellectual property, hereinafter jointly or severally referred to as the "Seller")

These general conditions of sale have been established by Thensel snc with headquarters in via Bassa dei Magnani, 7 - 43121 Parma, Italy, VAT number and Tax Code 02491780348.

These general conditions of sale apply to all online sales concluded between the SELLER and any person domiciled in a country of the European Union or non-European Union who makes an online purchase (hereinafter the "Customer") on the Seller's websites www.mytodoplanner.com and www.graphiceditor.mytodoplanner.com (hereinafter the "Sites").

The Customer declares to have read these general conditions of sale before placing an order by ticking the corresponding box. They are expressly accepted without reservation by any Customer who makes an online purchase through the Seller's website. The Customer waives the right to make use of contrary provisions or provisions not expressly provided for in these general conditions of sale.

1.2 WEBSITES

The Site allows you to take advantage of web to print services (collectively the "Services"), including personalized printing of documents and on various media (the "Products") with home delivery, or with delivery to third parties through delivery services postal services on the national and international territory (the "Mailing Service"). Unless otherwise specified, these Conditions apply to all Services offered by the Seller, where compatible.

To purchase the Services it is necessary to register on the Site in the appropriate customer reserved area. During the registration phase, Users will be asked to specify whether they intend to register and therefore make purchases as a company, sole proprietorship/freelancer, private individual or association, also specifying the Customer's nationality and billing/shipping data. Only the purchases of Services made by private Users will be subject to the regulations applicable to consumers, pursuant to the provisions of Legislative Decree no. lgs. 06.09.2005 n. 206 (the "Consumer Code").

All final prices of the Services displayed on the Site are expressed in euros, shipping costs included and VAT included for customers belonging to the Union  European.

The Seller reserves the right to modify these general conditions of sale at any time. Any new version will apply to all orders placed after its first publication on the website.

2. TO PLACE AN ORDER

​

2.1 REGISTRATION

To access the "Graphic Editor" Site (www.graphiceditor.mytodoplanner.com)  the Customer can decide whether to authenticate, register or proceed anonymously. In order to place an order, the Customer must first register on the "Graphic Editor" Site and create an account with his data. To place an order for gift cards you need to register on the Website ( www.mytodoplanner.com)

When creating the account, the Customer must ensure the accuracy and completeness of the data provided. The Customer is required to update their personal information. In the event of an error in the recipient's address, the Seller cannot be held responsible for the non-delivery of the products

By registering on the Site, the Customer declares and guarantees to the Seller that he is of age and that he has full legal capacity and to act. The Seller may remove a customer account at any time, for any reason, at its discretion.

The TCV apply to the product once the order, including the details of the items, their price and any associated expenses, has been validated by the customer.

2.2 PRODUCTS  

The products presented by the Seller are valid as long as they remain online on the Site.

The images and photographs are as accurate as possible, but may not provide an exact resemblance to the Products sold, particularly as regards the colors.

In case of unavailability of one or more Products ordered by the Customer, the Seller undertakes to inform the Customer as soon as possible and to reimburse them without delay, at the latest within 14 days from the Customer's payment. The refund will be made by bank transfer to the Customer's bank account. The Customer's order will then be automatically canceled.

2.3 PURCHASES  

After being authenticated, the customer can proceed with the purchase of the Products and define your order, selecting them from time to time, personalizing them, and adding the desired quantities to your shopping cart, as well as possibly opting for the personalized Greeting Card Service combined with the chosen Product. Once the order is confirmed and completed the payment, the Customer will be redirected to the personal area to view the status of his order at any time.

All orders containing more than 5 Products, both by species and quantity, will be handled individually by the Seller. The Customer will only need to confirm the acceptance of the order and he will be contacted within the following 72 hours via email with a commercial proposal or timing for the processing of his order; in the same email, the Customer will be able to confirm the Seller's proposal using the appropriate button to complete the payment, only when this is completed and confirmed the Seller will process the order.  

The realization of our products is done by hand and is taken over upon receipt of the order and payment. The lead times for an average order are approximately 72 hours; the Customer will be notified in your user area within the "Graphic Editor" site, both when your order is being processed and when the order is fulfilled.

The Customer remains the only person responsible for checking the contents, spelling, graphics, coloring and everything that can be modified and edited inside of the Graphic Editor.

The Seller reserves the right, at its sole discretion, not to process any order. This may also happen in the event that:

- the data provided by the Customer when completing the order form are incomplete or incorrect;

- the ordered Products are not available.

In the cases indicated above, the Seller will inform the Customer by e-mail that the order has not been accepted (in whole or in part) specifying the reasons. The Seller will reimburse the Customer for any sums already paid by the latter.

 

2.4 AVAILABILITY

The products presented by the Seller are valid as long as they remain online on the Site.

2.5 PRICE AND PAYMENT

All final prices of the Services displayed on the Sites are expressed in euros, including shipping costs and VAT included for customers belonging to the Union  European.

The products are invoiced to the Customer according to the prices indicated on the Sites at the time of the order.

The Sites are equipped with a secure online payment system. Payments are made by card: Visa, Mastercard, debit card; or PayPal.

The Customer guarantees the Seller that he has the necessary authorizations to use the payment method chosen at the time of the order.

The information necessary for the payment will be forwarded, through encrypted protocols, to the institute payment systems which are entrusted by the Seller with remote electronic payment services, without the possibility of access by third parties. Payments must be made in advance and, only after the payment and the upload of the "compliant" file by the Customer, the selected items will be put into production.

The Seller reserves the right to suspend the fulfillment of any order and any delivery in case of refusal of the authorization to pay by officially accredited bodies.

The Seller also reserves the right to refuse delivery or to honor an order from a Customer who has not paid for a previous order or with whom a payment dispute is pending.

​

The delivery period starts from the date of fulfillment of the order.

The invoice will be delivered to the Customer attached to the purchased product.

 

2.6 - DELIVERY
We ship FREE to all countries listed using 2 trusted companies (Fedex and Mailbox Etc.), to ensure fast, controlled and safe delivery.  go to list

FOR NON-EUROPEAN CUSTOMERS: THE PRICE IS ALREADY EXCL. 22% VAT.

Customs duties are charged to the customer. In some countries outside Europe, additional taxes (customs duties, import taxes) may be applied, which must be paid by the Customer upon arrival of the package in the country of destination.

​ You can consult the progress of your order through your User area within the " Graphic Editor" site. After your order has been shipped, you will receive an automatic email with a track & trace number, so you can easily track your package.

If the country of delivery is not in our country list, we invite our customers to contact us by email at: info@mytodoplanner.com where we will do our best to help you.

​Delivery is made to the delivery address indicated by the Customer. The Customer must ensure that he has provided accurate and complete information regarding the delivery address (in particular: house number, property, staircase, access codes, names and/or intercom numbers, etc.).

The delivery times indicated on the Site are provided as an indication and correspond to the average delivery time.

​

​At the time of delivery, if the package is open, damaged, defective or in poor condition, the Customer must refuse to accept the delivery and send it back. If the Customer decides to accept the package, he must write on the delivery receipt that acceptance is conditional, indicating the conditions and any problems with the package, communicate the event to the Seller and the delivery company within 3 working days.

​In case of delay in delivery, if after having asked the Seller to make the delivery within a reasonable additional period of time, the latter has not done so, the Customer has the right to cancel the order by sending an e-mail to: info@mytodoplanner.com clearly specifying the reference number of the order to be canceled.

The Customer will then be reimbursed promptly and at the latest within 14 days from the date of cancellation of the order. However, if the product has been received after the cancellation of the order by the Customer, the latter will return it to the Seller and the sums paid, including the return costs, will be fully refunded upon receipt by the Seller of the product. complete and in its original condition.

​The Seller cannot be held responsible for any direct or indirect damage resulting from delays or damage due to delivery.

 

 

3. RIGHT OF CANCELLATION AND WITHDRAWAL

The use and purchase of the products and Services provided by the Seller are immediate.

THE CANCELLATION OR MODIFICATION OF ORDERS ARE BEING PROCESSED IN THE USER AREA OF THE MYTODO GRAPHIC'S EDITOR "SITE" ARE NOT ALLOWED.

From the moment the order is being processed, the Seller will no longer be able to intervene on the manufacturing process of the Product.

It is also not technically possible to change the order parameters relating to:

  • Promotional codes not entered;

  • Wrong number of copies;

  • Sending the same order more than once;

  • Other errors on the Customer side (ex. layout, positioning on the edges, etc.).

 

WE RECOMMENDED OUR CUSTOMERS  TO CAREFULLY CHECK THE SETTING BEFORE SENDING THEIR ORDERS.

The Customer can exercise the right of withdrawal only and exclusively for defects or faults of the Product due to the manufacture of the same and not, by way of example, to errors caused by layouts, transparency, positioning on the edge, etc.)

The order can be returned for a full refund or exchange within 14 days, and the process is extremely simple and FREE.

To exercise the right of withdrawal, the Customer can use the withdrawal form available on the site by clicking on the appropriate section or send an e-mail to: info@mytodoplanner.com indicating the order number, your name, the name of the product to be returned and a description of the flaws or defects, attaching photographic documentation. go to the return form

The Seller will send the Customer the return label by e-mail to be printed. It is essential that this acknowledgment of receipt is attached to the package, along with a copy of the invoice. The Customer must keep the proof of postage of the package. If the package is lost, no refunds will be provided without this proof of postage.

Products must be returned in their original packaging, with original tags, and brand new, without them having been used.

Within a maximum of 15 working days of receipt of the items by the Seller, (after reviewing the condition of the items) a refund will be issued with the original payment method, or the new items will be shipped (in case of an exchange).

If the product is defective or different from the one ordered, the Seller will pay the return of the product.

 

The refund of an Order paid with a Gift Card will be automatically refunded with a voucher.

4.  INTELLECTUAL PROPERTY

All elements of the Sites and the Sites themselves are protected by copyright, trademarks, designs and/or other intellectual property rights. These elements are the exclusive property of Thensel snc. All rights reserved.

These elements belong to Thensel snc or are used with the consent of their owners.

The reproduction or representation of these elements without the prior written consent of Thensel snc constitutes counterfeiting an acts punishable under the Intellectual Property Code and the Criminal Code.

It is strictly forbidden to reproduce (except for personal and non-commercial use), publish, modify, transmit, distribute, display, remove, delete and add to this website the elements and software contained therein.

All text, graphics, illustrations and photographs reproduced on the Sites are the property of the Seller and are reserved under the law on intellectual property.

 

5. LIABILITY

With the conclusion of a contract concerning the Mailing Service, the customer, as Data Controller, appoints Thensel snc, who accepts, as Manager (hereinafter 'Manager') of the processing (pursuant to Article 28 of the 2016 EU Regulation / 679 the General Data Protection Regulation - the "Regulation") of the personal data of which the customer is the owner.

The Data Controller entrusts the Manager, who accepts, with the task of carrying out, on his behalf, the processing operations functional to the correct execution of the Mailing Service, including, for purely illustrative and non-exhaustive purposes, archiving, processing, printing and Mailing. as well as any other operation strictly necessary to the exact fulfillment of their service covered by the Contract in a lawful manner, according to fairness, in compliance with the provisions of the Regulations and the Contract. The Manager undertakes to process the data exclusively in order to fulfill the Mailing Service referred to in the Contract.

 

The Customer must be considered as the sole Data Controller with reference to the Data processed pursuant to the Contract. The Customer is required to comply with the obligations imposed on him by the Regulation as Data Controller and must, in particular, ensure that (a) the information provided to the Data Processor is correct and updated, and (b) the acquisition and processing of data in the scope  of the Contract takes place in compliance with the principles of the Regulation and by virtue of a legitimate legal basis pursuant to art. 6 and 9 of the Regulation.

 

The Manager undertakes:

a) to process personal data lawfully, fairly, in compliance with the provisions of this Agreement, the Regulations, and any further instructions received from time to time by the Data Controller regarding the processing of personal data;

b) identify and designate the Officers and provide them with detailed instructions, consistent with this Agreement, for a correct and lawful processing of personal data, supervising their work;

c) allow the Officers to access only personal data whose knowledge is strictly necessary to fulfill the tasks assigned to them, imposing on them, in the acts of designation, compliance with the obligation of confidentiality regarding the data processed;

d) adopt the technical and common sense measures to prepare a safety system suitable to comply with the provisions of Articles 32 and ss. of the Regulation, in order to avoid that personal data are dispersed or destroyed, even accidentally and, above all, that unauthorized persons can access them or that, by authorized subjects, treatment that is not permitted or does not comply with the aforementioned purposes is carried out, as well as guaranteeing in particular the application of security measures for the processing of personal data adequate pursuant to art. 32 of the Regulation;

e) collaborate with the Data Controller in order to guarantee the interested party  requesting the effective exercise of the rights provided for by art. 15 and ss. of the Regulations;

f) assist the Data Controller if he intends to carry out an impact assessment on the protection of personal data pursuant to art. 35 of the Regulation relating to a treatment carried out by Thensel snc on behalf of the Data Controller;

g) notify the Data Controller without delay and in writing of any violation of personal data and offer him reasonable assistance and collaboration to ensure the fulfillment of the obligations referred to in Articles. 33 and 34 of the Regulation;

 

 

6. PERSONAL DATA AND COOKIES

6.1 SUBSCRIPTION TO THE NEWSLETTER

Subscription to the Mytodo planner Newsletter is made possible by simply providing your e-mail address using the specific registration form. No newsletters will be sent to registered customers or users without specific registration for the newsletter service. All newsletters contain an unsubscribe link from the service.

6.2 THIRD PARTIES

Thensel snc will not disclose your data to third party companies other than those involved in the payment and execution of your order. 
This information is never shared with third party companies or resold. Finally, Thensel snc does not store any bank data. Transactions are processed entirely by PayPal or our partner Stripe's secure payment module.

To improve our service, the website may use cookies. This means that customers don't have to log in every time they visit. A cookie is a computer file stored on the Customer's hard drive, which allows the Customer to be recognized, without time limits. Customers can of course delete these cookies by disabling their use in their browser.
 

 

7. DISPUTE RESOLUTION

These general conditions of sale and online purchase/sale operations are governed and interpreted by Italian laws.

Any dispute will be brought before the competent courts of Milan (Italy).​
